Cancellation Policy and Cancellation (withdrawal) form
Consumers
are entitled to a right of withdrawal according to the following provision,
whereby a consumer is any natural person who concludes a legal transaction for
purposes that can predominantly be attributed neither to his commercial nor his
independent professional activity:
A. Cancellation policy
Right of withdrawal
You have
the right to withdraw from this contract within fourteen days without giving
reasons.
The
withdrawal period is fourteen days and, in the case of a purchase, begins on the
day on which you or a third party designated by you, who is not the carrier,
have taken possession of the goods or, in the case of partial deliveries, the last
goods. In the case of rental, the withdrawal period is fourteen days from the
date of conclusion of the contract.
To
exercise your right of withdrawal, you must inform us

of your
decision to withdraw from this contract by means of a clear statement (e.g. a
letter or e-mail sent by post). You can
use the attached model withdrawal form, which is not mandatory. You may also use the electronic withdrawal
function available on our website www.lotusbelle.de/en.
In order
to comply with the withdrawal period, it is sufficient to send the notification
of the exercise of the right of withdrawal before the expiry of the withdrawal
period.
However,
in the case of a rental agreement, this means that the start of the rental
period and the delivery of the goods cannot take place until 14 days after
conclusion of the contract.
You can
also demand that the rental period begins before the end of the cancellation
period, thereby waiving your right of cancellation.
Electronic withdrawal function
Consumers may also exercise
their right of withdrawal electronically via the withdrawal function available
on our website.
The withdrawal
function allows consumers to electronically submit their withdrawal declaration
through an online form. After
submission, the consumer will receive confirmation of receipt of the withdrawal
request by e-mail.
Use of the electronic
withdrawal function is optional. Consumers may alternatively exercise their
right of withdrawal by any clear statement, including e-mail or post.
Waiver of the right to withdraw from the
contract in case of rent
You have no right of withdrawal if you rent a tent and the rental period
begins with your express consent combined with your knowledge of the loss of
the right of withdrawal in the event of premature commencement with the
fulfilment of the contract, even before the expiry of the withdrawal period.
Explanation and acknowledgement for rent
from the beginning of the provision of services before expiry of the
statutory 14-day withdrawal period:
By submitting the rental offer or accepting our offer (booking), you
therefore expressly declare your agreement and acknowledge that the rental will
commence before the expiry of the 14-day cancellation period. You expressly
agree that in this case there is no longer any right of withdrawal and you
expressly acknowledge the loss of the right of withdrawal.
Consequences of withdrawal
If you withdraw
from this contract, we shall reimburse you for all payments we have received
from you, including delivery charges (other than any additional charges arising
from your choice of a delivery method other than the cheapest standard delivery
offered by us), immediately and no later than fourteen days from the date on
which we receive notice of your withdrawal from this contract. We will use the
same means of payment for this refund as you used for the original transaction,
unless expressly agreed otherwise with you.
Under no
circumstances will you be charged for this refund. We may refuse to refund
until we have received the goods back or until you have provided proof that you
have returned the goods, whichever is earlier.
You must
return or hand over the goods to us without delay and in any case within
fourteen days at the latest from the day on which you inform us of the
withdrawal from this contract. This period is deemed to have been observed if
you send the goods before the expiry of the fourteen-day period.
You bear
the direct costs of returning the goods.
You will only have to pay for
any loss of value of the goods if this loss of value is due to handling of the
goods which is not necessary for checking their nature, properties and
functioning.
Exclusion or premature expiration of the right
of withdrawal
The right of withdrawal does
not apply to consumers who do not belong to a member state of the European
Union at the time of conclusion of the contract and whose sole residence and
delivery address at the time of conclusion of the contract are outside the
European Union, unless the law of the consumer's place of residence provides
for such a right of withdrawal.
Furthermore, the right of
withdrawal does not apply to contracts for the delivery of goods that are
manufactured according to customer specifications or clearly tailored to
personal needs.
Furthermore, you have no right
of withdrawal if you rent a tent and the rental period begins with your express
consent combined with your knowledge of the loss of the right of withdrawal in
the event of premature commencement with the fulfilment of the contract, even
before the expiry of the withdrawal period.

withdrawal function available on our website www.lotusbelle.de instead
of the model withdrawal form below.
